These terms and conditions govern your use of the Roadkills India citizen science application and related services. By using the app, you agree to comply with and be bound by these terms. If you do not agree, please do not use the app.

1. Acceptance of Terms and Conditions

By accessing, downloading and installing or using the Roadkills India app, you agree to be bound by these terms and conditions governing the usage of the app and participation in the citizen science campaign. If you do not agree to these terms, you may not use the app.

We grant you a non-exclusive, non-transferable, limited license to use the app for personal, non-commercial purposes related to citizen science and monitoring of deaths of animals along roads, railway, power lines and canals etc.

2. Lawful Use

You agree to use the app responsibly and in compliance with the Indian (Forest) Act, 1927, the Wildlife (Protection) Act, 1972, The Railways Act, 1989, The Motor Vehicles Act, 1988 and all other applicable laws and regulations.

You agree to ensure your own safety and watch out for oncoming traffic while taking photographs of dead animals and submitting data using the Roadkills India mobile app.

5. Purpose of Contributions

By contributing data, you agree that your submissions are intended for wildlife and its conservation, promoting scientific research and fostering awareness about the perils of linear infrastructure for wild animals. All contributions must be accurate to the best of your knowledge.

6. License Grant to LRCF

Your submissions will be used to help understand and address roadkill issues. You grant us a worldwide, royalty-free, perpetual, and irrevocable license to use, display, and analyze your data (photographs, position and date-time related meta data) in connection with the project's mission.

You may, at any time, delete your account and personal identifiers — either using the in-app Delete Account button (Profile screen) or by visiting our deletion request page on roadkillsindia.org. Roadkill records you have contributed remain in the scientific dataset but are anonymized upon account deletion (specifically, the user identifier is removed and the contributor name is replaced with "Anonymous Contributor"). This permanence preserves the scientific integrity of the dataset while respecting your rights under the Digital Personal Data Protection Act, 2023. 7. Community Guidelines

You agree to follow community guidelines and ethical standards when submitting observations. This includes respecting the dignity of wildlife and ensuring that your contributions do not harm animals or their habitats.

8. Ownership of Submitted Content

You retain ownership of any content you submit through the app. However, by submitting content, you grant us a license to use, display, and distribute that content in connection with the app's objectives.

9. Content Removal

All user-submitted content must comply with applicable laws and our content guidelines. We reserve the right to remove any content that violates these guidelines or is otherwise objectionable.

10. Intellectual Property

All content and materials available through the app, including text, graphics, logos, and software, are the property of LRC Foundation or its licensors and are protected by intellectual property laws. You may not use any content from the app without our prior written consent.

11. No Warranty

The app is provided "as is" without warranties of any kind. We do not guarantee the accuracy, reliability, or completeness of any information or content provided through the app.

12. Release of Liability

You agree to hereby waive, release, and forever discharge any and all rights and claims for damages, for death, personal injury, or property damage which you may incur, or which may hereafter accrue to you as a result of your participation in the citizen science campaign Roadkills India and the use of the Roadkills India mobile app.

This release is intended to discharge in advance the founders, directors, staff, consultants, and volunteers of LRC Foundation, from and against any and all liability arising out of or connected in any way with your participation in the Roadkills India campaign and use of the mobile app.

You understand that slowing your vehicle to park by the roadside, and taking photographs on the road involves a risk, and you hereby agree to assume those risks and to release and hold harmless all of the persons or entities mentioned above for damages. You realize that you are ultimately responsible for your own safety and you agree that you will not hold the LRC Foundation, its directors, staff and volunteers responsible for anything that could happen to you or a fellow passenger travelling with you.

13. Limitation of Liability

To the fullest extent permitted by law, LRC Foundation, its directors, staff, consultants and volunteers are not liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the app.

14. Changes to These Terms

We may update these Terms of Use from time to time. We will notify you of any material changes by posting the updated terms in the app or on our website. Your continued use of the app after such changes constitutes your acceptance of the new terms.

15. Termination

We reserve the right to terminate or suspend your access to the app at our sole discretion, without notice, if we believe you have violated these terms or engaged in any unlawful behavior.

16. Use by Minors

The Roadkills India app is intended for users who are 18 years of age or older. By using this app, you confirm that you are at least 18 years old.

If you are under 18, you may use the app only with the verified consent of a parent or legal guardian, and they accept these Terms and Conditions on your behalf. The parent or guardian assumes full responsibility for the minor's safety while using the app, including all road-related risks described in Section 12.

We do not knowingly collect personal data from children under 13 years of age. If we discover that we have collected such data without verified parental consent, we will delete it promptly.
